1. Agreement to Terms

These Terms and Conditions ("Terms") govern your use of the YouGot website (yougot.ai) and reminder service delivered via SMS, WhatsApp, email, web push notifications, webhooks, and API access (collectively, the "Service") operated by Foresight AI Partners LLC ("Company," "we," "us," or "our").

By accessing or using the Service — including signing up for a free account — you agree to be bound by these Terms. All subscription tiers, including the free tier, constitute a binding agreement under these Terms. If you do not agree to these Terms, you may not use the Service. You must be at least 18 years of age or the age of majority in your jurisdiction to use the Service.

2. Description of Service

YouGot is an AI-powered reminder service that allows you to create reminders using natural language in any language. You type what you want to be reminded about, and YouGot uses artificial intelligence to parse your request, schedule it, and deliver a reminder to you via SMS, WhatsApp, email, web push notification, or webhook at the specified time.

The Service includes, but is not limited to, the following features:

• AI-powered natural language parsing and scheduling via conversational AI sessions
• Reminder delivery via email, SMS, WhatsApp, web push notifications, and webhooks
• Nag mode: persistent, repeated notifications until the reminder is acknowledged by the user
• Live data features including cryptocurrency prices, weather forecasts, stock quotes, and news summaries sourced from third-party providers
• Team, group, and family features with shared reminders
• API access (Business tier) for programmatic reminder management with webhooks and rate limits
• SMS commands including TEXT, STATUS, LIST, DONE, SNOOZE, HELP, STOP, and START
• Reminder sharing with engagement tracking (views, likes, clones)
• Referral program with reward credits

Message and data rates may apply for SMS and WhatsApp. Message frequency depends on your reminder settings and plan limits.

4. WhatsApp Terms

WhatsApp delivery is subject to Meta's WhatsApp Business Policy. By opting in to WhatsApp reminders, you agree to receive messages from YouGot via the WhatsApp Business Platform. WhatsApp messages are delivered through Twilio's integration with Meta's WhatsApp Business API.

You can opt out of WhatsApp messages at any time by replying STOP or changing your delivery preferences in your dashboard. After opting out, reminders will be delivered via email.

5. Account and Registration

To use certain features of the Service, you may need to create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as needed
• Keep your account credentials secure
• Accept responsibility for all activity that occurs under your account

6. User Responsibilities

You agree to:

• Provide a valid mobile phone number that you own or are authorized to use
• Use the Service only for lawful purposes and in compliance with these Terms
• Not use the Service to send reminders containing illegal, harmful, threatening, abusive, or otherwise objectionable content
• Not attempt to interfere with or disrupt the Service or its infrastructure
• Be solely responsible for the content of your reminder messages
• Not reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, or underlying structure of the Service or any of its components
• Not scrape, crawl, spider, or use any automated means to access or extract data from the Service except through officially provided APIs
• Not copy, reproduce, distribute, or create derivative works of the Service, its code, database structure, or any proprietary component
• Not attempt to discover trade secrets, proprietary methods, or confidential information of the Service

7. Subscription Plans and Billing

YouGot offers subscription plans across four tiers: Free, Pro, Plus, and Business. All tiers — including the free tier — constitute a "subscription" and are subject to these Terms. By creating an account on any tier, you enter into a binding agreement governed by these Terms.

Paid plans are billed monthly or annually through our payment processor (Stripe). Current pricing is available at yougot.ai/#pricing. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis. Pricing is subject to change; current pricing is always listed on our pricing page.

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods.

8. Monthly Message Limits

Each plan includes monthly limits on SMS, WhatsApp, and email messages. Limits reset on the 1st of each month. When a channel limit is reached, the platform attempts to deliver reminders via email as a fallback; however, delivery through any channel is not guaranteed.

All plans have defined monthly message limits to ensure service quality. No plan includes unlimited messaging.

9. Fair Use Policy

The Service is intended for personal and legitimate business reminder use. We reserve the right to suspend or limit accounts that exhibit usage patterns inconsistent with normal reminder activity, including but not limited to:

• Using the Service to send bulk marketing or promotional messages
• Creating excessive numbers of reminders designed to circumvent plan limits
• Using API access (Business tier) in ways that impose unreasonable load on our infrastructure
• Sharing account credentials to exceed per-plan member limits

We will notify you before taking any action on your account and provide an opportunity to adjust your usage.

10. Account Monitoring & Abuse Detection

We use automated systems to detect and prevent misuse of the Service, including but not limited to:

• Attempts to manipulate or exploit our AI reminder parsing system (e.g., prompt injection, system manipulation)
• Attempts to inject malicious code or content into reminders, tags, or other user-provided fields
• Excessive API usage beyond plan rate limits or message quotas
• Artificial inflation of engagement metrics (views, likes, shares)
• Fraudulent use of the referral or free month credit programs
• Attempts to access internal systems or private network resources through webhook URLs

When suspicious activity is detected:

• The activity is logged, including the original content or request that triggered the detection
• The activity is categorized by type and severity
• You will be notified via email if your account is flagged
• We review flagged accounts to determine appropriate action

11. Account Suspension & Termination

Warning: If we detect activity that may violate these Terms, we will send you an email notification describing the type of activity detected. Your account remains active during the warning period. You have the opportunity to adjust your usage. However, continued activity of the same nature after a warning may result in immediate suspension or permanent termination of your account without further notice.

Suspension: If violations continue after a warning, if severe violations are detected, or if our automated systems detect sustained abusive activity, your account may be temporarily suspended without additional notice. During suspension:

• Your existing reminders are paused but not deleted
• You cannot create new reminders or use the API
• Your data is preserved for 90 days per our Privacy Policy

Termination: In cases of serious or repeated violations, we may permanently terminate your account. Terminated accounts:

• Cannot be reactivated
• Data is deleted per the retention schedule in our Privacy Policy

Appeals: If you believe your account was flagged or suspended in error, you may appeal by emailing support@yougot.ai within 14 days. Include your account email and a description of the activity. We will review and respond within 5 business days.

12. AI Processing Disclosure

Your reminder text is processed by AI (powered by large language models including Anthropic Claude, accessed via OpenRouter) to:

• Parse dates, times, and scheduling intent from natural language
• Classify the type of reminder and suggest tags
• Support conversational reminder management via SMS, WhatsApp, and web-based AI conversation sessions
• Fetch and summarize live data (cryptocurrency prices, weather forecasts, stock quotes, news) from third-party sources

Important disclosures:

• Anthropic does not retain your reminder content for AI model training
• We scan reminder text for abuse patterns (such as prompt injection attempts, malicious code, or harmful content) as part of our automated security measures
• The AI processes text as data for structured extraction only — it does not execute instructions contained within reminder text
• Live data features (crypto prices, weather, stock quotes, news) use third-party APIs; their respective privacy policies apply
• AI-powered large language models (LLMs) are inherently probabilistic and may produce errors in parsing, scheduling, date extraction, time zone interpretation, or content classification. You MUST always verify all AI-parsed reminder details — including date, time, recurrence, and content — before relying on them. Foresight AI Partners LLC and YouGot are not responsible for any consequences arising from AI parsing errors or inaccuracies.

13. Opt-Out Rights

You may opt out of YouGot SMS or WhatsApp messages at any time by:

• Replying STOP to any YouGot message
• Replying HELP for assistance
• Changing your delivery preferences in your dashboard
• Contacting us at support@yougot.ai

After opting out, you will receive a confirmation message and no further SMS or WhatsApp messages from YouGot unless you re-opt in.

14. Intellectual Property & Reverse Engineering Prohibition

The YouGot name, logo, branding, website design, source code, algorithms, database structure, API design, and all related intellectual property are owned by Foresight AI Partners LLC. All rights not expressly granted to you under these Terms are reserved by Foresight AI Partners LLC.

You may not, and you agree not to:

• Copy, reproduce, modify, distribute, or create derivative works based on our intellectual property, source code, algorithms, database structure, or any component of the Service without prior written consent
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying architecture of the Service or any of its components
• Scrape, crawl, spider, or use any automated tools to access or extract data from the Service except through the officially provided API
• Attempt to discover trade secrets, proprietary methods, algorithms, or confidential business information of the Service
• Use automated tools, bots, or scripts to access the Service except through the official API provided to Business tier subscribers
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices contained in the Service

You retain ownership of the content of your reminders. By using the Service, you grant us a limited license to process and store your reminder content solely for the purpose of delivering the Service.

15. API Terms of Use

API access is available exclusively to Business tier subscribers and is subject to the following terms:

• API access is subject to rate limits as defined by your subscription plan. Exceeding rate limits may result in throttling or temporary suspension of API access.
• API keys are confidential credentials. You are solely responsible for the security of your API keys and must not share them with unauthorized parties. If you believe your API key has been compromised, you must regenerate it immediately.
• Webhook URLs provided by you must use HTTPS. You are solely responsible for the security, availability, and proper functioning of your webhook endpoints.
• Foresight AI Partners LLC is not liable for webhook delivery failures caused by your endpoint being unavailable, returning errors, or failing to respond within the timeout period.
• API access may be revoked immediately and without notice for abuse, violation of these Terms, or usage patterns that impose unreasonable load on our infrastructure.
• You may not use the API to build a competing service, resell access, or provide the Service to third parties without our prior written consent.

16. User Content & Shared Reminders

You are solely responsible for all content you create, submit, or share through the Service, including but not limited to reminder text, tags, notes, and shared reminders ("User Content").

• By sharing a reminder publicly or with other users, you grant those users a non-exclusive license to view, clone, and interact with the shared reminder content.
• You represent and warrant that your User Content does not violate any applicable law or infringe on the rights of any third party.
• We reserve the right to remove, disable, or restrict access to any User Content that violates these Terms, without prior notice to you.
• We do not endorse, verify, or assume responsibility for any User Content. You acknowledge that other users' shared reminders may contain inaccurate or objectionable content.

17. Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that:

• The Service will be uninterrupted or error-free
• SMS, WhatsApp, email, push notification, or webhook messages will be delivered at the exact scheduled time, or delivered at all
• AI parsing of your natural language input will always be accurate, including date extraction, time zone interpretation, recurrence scheduling, or content classification
• The Service will be compatible with all mobile carriers or devices
• Reminders will be delivered if you have exhausted your monthly message limits under your current plan
• Live data features (cryptocurrency prices, weather forecasts, stock quotes, and news summaries) will be accurate, timely, complete, or available at any given time
• Third-party services on which the Service depends (including messaging, payment, authentication, AI processing, data, and cloud infrastructure providers) will be available or perform as expected

YouGot makes its best effort to deliver reminders on time and through your chosen channel; however, delivery may fail or be delayed due to carrier network issues, device connectivity, WhatsApp or push notification service availability, internet outages, service maintenance, software errors, AI parsing errors, third-party service outages, or plan message limits being reached. Neither Foresight AI Partners LLC nor YouGot shall be held liable for any reminder that is not delivered, is delivered late, or is delivered inaccurately for any reason.

Mobile carriers are not liable for delayed or undelivered messages.

18. Third-Party Services Disclaimer

The Service integrates with and relies upon third-party services and data providers for various purposes, including but not limited to:

• Live data: Real-time information such as cryptocurrency prices, weather forecasts, stock quotes, and news summaries sourced from third-party data providers
• Delivery infrastructure: Third-party messaging and communication providers for SMS, WhatsApp, email, and push notification delivery
• Platform services: Third-party providers for authentication, payment processing, cloud hosting, AI processing, and analytics

Foresight AI Partners LLC does not guarantee the accuracy, timeliness, completeness, or availability of any third-party data or services. Third-party service outages, errors, or discontinuations may affect reminder delivery, live data accuracy, billing, authentication, or other aspects of the Service.

You acknowledge and agree that your reliance on third-party data provided through the Service — including but not limited to cryptocurrency prices, weather data, stock quotes, and news — is entirely at your own risk. Such data is provided for informational purposes only and should not be used as the sole basis for financial, health, safety, or other critical decisions.

20. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FORESIGHT AI PARTNERS LLC, YOUGOT, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO:

• Damages arising from missed, delayed, undelivered, or inaccurately delivered reminders regardless of their nature or purpose
• Damages arising from AI parsing errors, scheduling inaccuracies, or incorrect date/time extraction
• Damages arising from reliance on live data (crypto, weather, stocks, news) provided through the Service
• Damages arising from third-party service failures or outages
• Loss of data, profits, revenue, business opportunities, or goodwill
• Any harm, injury, or adverse outcome resulting from reliance on the Service for health-related, medical, financial, legal, or other critical reminders

This limitation applies whether the damages are based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, even if Foresight AI Partners LLC has been advised of the possibility of such damages.

Our total aggregate liability for any and all claims arising from or related to the Service shall not exceed the total amount you paid to us in the twelve (12) months preceding the claim, or $100, whichever is greater.

21. Indemnification

You agree to indemnify, defend, and hold harmless Foresight AI Partners LLC, YouGot, and their respective officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use or misuse of the Service
• Your violation of these Terms or any applicable law or regulation
• Your User Content, including any claims that your content infringes or violates the rights of any third party
• Your negligent or wrongful conduct
• Any unauthorized use of your account or API keys

22. Force Majeure

Neither Foresight AI Partners LLC nor you shall be liable for any failure or delay in performance of obligations under these Terms caused by events beyond reasonable control, including but not limited to: natural disasters, pandemics, epidemics, acts of God, war, terrorism, government actions or orders, civil unrest, internet or telecommunications failures, power outages, cyberattacks, and outages or failures of third-party service providers on which the Service depends (including messaging, payment, authentication, AI processing, data, and cloud infrastructure providers).

In the event of a force majeure, the affected party shall use commercially reasonable efforts to resume performance as soon as practicable.

23. Dispute Resolution & Arbitration

Informal Resolution: Before initiating any formal dispute resolution proceeding, you agree to first contact us at support@yougot.ai and attempt to resolve the dispute informally for at least thirty (30) days.

Binding Arbitration: If the dispute is not resolved informally within 30 days, any controversy or claim arising out of or relating to these Terms or the Service shall be settled by binding arbitration administered in El Paso County, Texas, in accordance with the rules of the American Arbitration Association. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver: YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration against Foresight AI Partners LLC.

Small Claims Court Exception: Notwithstanding the foregoing, either party may bring an individual action in small claims court in El Paso County, Texas, for disputes within that court's jurisdictional limits.

24. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in El Paso County, Texas.

25. International Users

The Service is operated from and controlled within the United States of America. If you access or use the Service from outside the United States, you do so at your own risk and consent to the transfer, processing, and storage of your data in the United States, which may have different data protection laws than your country of residence.

Foresight AI Partners LLC makes no representations that the Service is appropriate, available, or legally compliant for use in any particular jurisdiction outside the United States. You are solely responsible for compliance with all applicable local, national, and international laws and regulations in your jurisdiction.

26. Electronic Communications

By creating an account or using the Service, you consent to receiving electronic communications from us, including but not limited to account notifications, service updates, security alerts, billing communications, and legal notices. These electronic communications satisfy any legal requirement that such communications be in writing.

You agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing.

27. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms.

28. Severability & Entire Agreement

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions, which shall continue in full force and effect.

These Terms, together with our Privacy Policy and Messaging & Notification Terms, constitute the entire agreement between you and Foresight AI Partners LLC regarding your use of the Service and supersede all prior or contemporaneous agreements, understandings, or representations, whether written or oral.

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
